Subject: Principles for Award of Exemplary or Aggravated Damages in COnsumer Cases, under UCP

Dear all,

I would be very grateful if anyone could point me to authorities
concerning the principles that should be applied in awarding
aggravated or exemplary damages to consumer claimants, especially in
claims brought under any national incarnation of the Unfair Commercial
Practices Directive (Directive 2005/29/EC).

I am interested in material dealing with both:
1. Circumstances in which such damages should be awarded; and
2. The appropriate quantum of any such award.

Unfortunately, I am only in a position to read decisions in English.
